Legal entropy and power: a critical epistemological reading of legal uncertainty

This essay examines legal entropy as an analytical concept for understanding legal uncertainty and its connection to power relations in the Bolivian context, using the case of presidential reelection as an illustration. The objective is to demonstrate that legal uncertainty stems not only from problems in the application of the law but also from power strategies. A qualitative documentary approach was used, epistemologically adopting critical legal theory and methodologically leaning towards Foucault's genealogical approach. It argues that legal entropy operates as a power mechanism, producing differentiated effects: certainty for hegemonic sectors and uncertainty for those dispossessed of power. The essay concludes that law is a flexible and open order, used to consolidate power relations under the guise of constitutionality.
